Terms of Service
Acceptance of terms
By creating an account and using fAIshion you agree to these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you and Faishion LLC.
Description of service
fAIshion provides AI-powered tools for boutique owners including fAIshion Studio, which enables automated model swapping on product photos and publishing to connected e-commerce platforms. We may add additional products and features to the platform over time.
Account registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at help@faishion.io if you suspect unauthorized access to your account.
Subscriptions and billing
fAIshion is offered on a subscription basis. Your subscription begins on the date you complete checkout and renews automatically on the same date each month until cancelled. Credits are allocated at the start of each billing period and reset on your billing anniversary date. Unused credits do not roll over to the following period.
Top-off credits are a one-time purchase and expire on your next billing anniversary date.
All payments are processed by Stripe. By subscribing you authorize Faishion LLC to charge your payment method on a recurring basis. Prices are listed in US dollars.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods or unused credits.
We reserve the right to change pricing with 30 days notice to your account email address.
Free trial
New accounts receive 10 complimentary image generations. No payment information is required to use your free trial credits. Free trial credits expire 30 days after account creation.
Failed payments
If a payment fails, image generation will be restricted immediately while we attempt to process your payment. We will retry your payment automatically over 7 days. If payment is not resolved within 7 days we may suspend your account. Upon successful payment your subscription renews from that date and a fresh credit allocation is applied. Credits are not backdated for any period during which access was restricted due to non-payment.
Acceptable use
You agree to use fAIshion only for lawful purposes. You may not use fAIshion to:
• Process images you do not own or have rights to use
• Generate content that is deceptive, defamatory, or infringes on third party intellectual property
• Attempt to reverse engineer or circumvent any aspect of the platform
• Resell or sublicense access to fAIshion without written permission
• Use automated tools to access the platform in ways that exceed normal usage
Your content
You retain ownership of all photos and content you upload to fAIshion. By uploading content you grant Faishion LLC a limited license to process, store, and transmit your content solely for the purpose of providing the service to you. We do not claim ownership of your content and do not use your photos to train AI models.
You are responsible for ensuring you have the rights to upload and process any photos you submit to fAIshion, including rights to any models, garments, or other content appearing in those photos.
Generated images are stored in your account for 60 days from the date of generation, after which they are automatically deleted. You are responsible for downloading any images you wish to keep before the 60 day window closes.
Third party platform integrations
When you connect your Shopify or CommentSold account you authorize fAIshion to read and write product data on your behalf. You are responsible for ensuring your use of these integrations complies with the terms of service of those platforms. fAIshion is not responsible for changes to third party platform APIs that may affect functionality.
Intellectual property
The fAIshion platform, including its software, design, and content, is owned by Faishion LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without written permission.
Disclaimers
fAIshion is provided as is without warranties of any kind. We do not guarantee that the service will be uninterrupted, error-free, or that AI-generated images will meet your specific requirements. Image generation results may vary based on the quality and content of uploaded photos.
Limitation of liability
To the maximum extent permitted by law, Faishion LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of fAIshion. Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold Faishion LLC harmless from any claims, damages, or expenses arising from your use of fAIshion, your violation of these terms, or your violation of any third party rights.
Termination
We may suspend or terminate your account if you violate these terms, if your payment fails and is not resolved within 7 days, or if we discontinue the service. You may terminate your account at any time through account settings. Upon termination your data will be deleted within 30 days.
Governing law
These terms are governed by the laws of the State of Mississippi. Any disputes shall be resolved in the courts of Mississippi.
Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Your continued use of fAIshion after changes take effect constitutes acceptance of the updated terms.
