Terms of Service
Acceptance of terms
By creating an account and using fAIshion you agree to these Terms of Service. If you do not agree, do not use the platform. These terms constitute a binding agreement between you and Faishion LLC.
Description of service
fAIshion provides AI-powered tools for retailers, including fAIshion Studio (AI-generated product photography), InventoryIQ (turning purchase orders into ready-to-publish product listings for your connected store), and MarketPro (wholesale buying, shipment tracking, and budget management). We may add products and features to the platform over time.
Account registration
You must provide accurate and complete information when creating your account. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately at help@faishion.io if you suspect unauthorized access to your account.
Subscriptions and billing
Subscriptions are per product and renew automatically each month until cancelled. Usage allowances are allocated at the start of each billing period and do not roll over to the following period. Top-off purchases are one-time and expire on your next billing anniversary date.
Upgrades take effect immediately: you receive the new plan’s full allowance right away and are charged the difference in plan price at the time of upgrade. Downgrades take effect at the end of your current billing period.
Payments are handled by our third-party payment processor. By subscribing you authorize Faishion LLC to charge your payment method on a recurring basis. Prices are listed in US dollars.
You may cancel your subscription at any time through your account settings. Cancellation takes effect at the end of your current billing period. We do not offer refunds for partial billing periods or unused allowances.
We reserve the right to change pricing with 30 days notice to your account email address.
Free trials
New accounts may receive a complimentary usage allowance, shown at signup, with no payment information required. Trial allowances expire as stated at signup.
Failed payments
If a payment fails, paid features are restricted immediately while your payment is retried automatically. Purchases of additional usage do not restore access while a payment is outstanding. If payment is not resolved promptly we may suspend the account. Upon successful payment your subscription resumes and a fresh allowance is applied. Allowances are not backdated for any period during which access was restricted due to non-payment.
AI-generated content
Product listings, descriptions, and images produced by fAIshion are generated by artificial intelligence and may contain errors or inaccuracies. Everything fAIshion generates is presented to you for review and editing, and nothing is published to your store or sent to any third party without your action. You are responsible for reviewing AI-generated content before publishing it and for the accuracy of anything you publish.
Vendor connections and photo-finding
You may save sign-in credentials for your wholesale vendors’ websites, or complete a vendor sign-in through our secure connection flow. By doing so you authorize fAIshion to access those websites on your behalf, solely to retrieve product photos and product information for items you have purchased or are evaluating. You represent that you are authorized to access those vendor accounts and to use the retrieved materials in your business, and you are responsible for complying with your vendors’ terms. Saved credentials are stored encrypted; you can disconnect a vendor at any time.
Email integration
If you connect an email account, you authorize fAIshion to read authorized messages solely to extract order-related information such as purchase orders and tracking numbers. fAIshion may also prepare order-related messages, such as purchase orders to your vendors, for your review; messages are sent only when you choose to send them. You can revoke the email connection at any time.
Acceptable use
You agree to use fAIshion only for lawful purposes. You may not use fAIshion to:
• Process images or documents you do not own or have rights to use
• Generate content that is deceptive, defamatory, or infringes on third party intellectual property
• Attempt to reverse engineer or circumvent any aspect of the platform
• Resell or sublicense access to fAIshion without written permission
• Use automated tools to access the platform in ways that exceed normal usage
Your content
You retain ownership of all photos, documents, and content you upload to fAIshion. By uploading content you grant Faishion LLC a limited license to process, store, and transmit your content solely for the purpose of providing the service to you. We do not claim ownership of your content and do not use your content to train AI models.
You are responsible for ensuring you have the rights to upload and process anything you submit to fAIshion, including rights to any models, garments, or products appearing in photos.
AI-generated images are stored for a limited window (currently 30 days for Studio images and 45 days for AI-styled images in InventoryIQ), after which they are automatically deleted. You are responsible for downloading any images you wish to keep before their window closes.
Third party platform integrations
When you connect your e-commerce platform (such as Shopify or CommentSold), you authorize fAIshion to read and write product data on your behalf using the access you grant. You are responsible for ensuring your use of these integrations complies with the terms of service of those platforms. fAIshion is not responsible for changes to third party platforms that may affect functionality.
Intellectual property
The fAIshion platform, including its software, design, and content, is owned by Faishion LLC and protected by intellectual property laws. You may not copy, modify, or distribute any part of the platform without written permission.
Disclaimers
fAIshion is provided as is without warranties of any kind. We do not guarantee that the service will be uninterrupted or error-free, that AI-generated content will meet your specific requirements, or that photo-finding results will be complete or accurate. Results may vary based on the quality and content of what you upload and the availability of your vendors’ websites.
Limitation of liability
To the maximum extent permitted by law, Faishion LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of fAIshion. Our total liability to you for any claim arising from these terms or your use of the service shall not exceed the amount you paid to us in the 12 months preceding the claim.
Indemnification
You agree to indemnify and hold Faishion LLC harmless from any claims, damages, or expenses arising from your use of fAIshion, your violation of these terms, or your violation of any third party rights.
Termination
We may suspend or terminate your account if you violate these terms, if a failed payment is not resolved, or if we discontinue the service. You may terminate your account at any time through account settings. Upon termination your data will be deleted within 30 days.
Governing law
These terms are governed by the laws of the State of Mississippi. Any disputes shall be resolved in the courts of Mississippi.
Changes to these terms
We may update these terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. Your continued use of fAIshion after changes take effect constitutes acceptance of the updated terms.
